§ 1.05. Citizen's ordinance; submission.

  • It shall be the right of any citizen of the city to submit to the city council, in proper form for passage, any ordinance or resolution affecting the public interests of the city, for enactment; and if the same be signed or approved in writing by twenty-five (25) percent of those registered to vote at the last preceding election, it shall be the duty of the council to pass upon such ordinance or resolution not later than the second regular meeting thereafter; and if it fails to pass, the petition shall be transmitted by the clerk to the election superintendent within two (2) days thereafter, and it shall be the duty of the election superintendent to call an election to be held not later than thirty (30) days after the receipt of the petition. If the majority of those voting in said election vote for the measure, it shall be the duty of the city council to pass the same at its next regular meeting after the election.
