§ 5.05. Removal from office, vacancies.

  • In case of one (1) vacancy on said board occurring other than by reason of expiration of a term of office, the remaining members of the board, at a regular meeting or a special meeting called for such purpose, shall elect a qualified person to serve as a member of the board for the unexpired term. In the event the board is unable to fill any such vacancy within thirty (30) days, a special election shall be held to fill the vacancy.

    At no time shall there be more than one (1) board member so appointed holding office, and if a vacancy occurs on the board with one (1) member so appointed on the board, a special election shall be held not less than thirty (30) days, nor more than sixty (60) days after the office becomes vacant pursuant to a call of a special election as provided by this charter; however, if a special election is called pursuant to this charter, the vacancy previously filled by appointment as well as the existing vacancy shall be filled for the unexpired terms in a special election. Provided, however, if a regular election shall be held within three (3) months after the second vacancy occurs, the first vacancy previously filled by appointment and the second vacancy may be filled for the unexpired terms at such regular election.
