§ 10-520. Appeals; city council review hearing.

  • (a)

    Any party aggrieved by a staff decision under this article shall have the right of appeal directly to city council. The aggrieved party shall file a request for appeal with the city clerk to be docketed on the next regularly scheduled city council meeting, or within thirty (30) days from filing the appeal.

    (b)

    If the police chief suspends a pain clinics occupational tax certificate or occupation tax permit, a review hearing before the city council shall be scheduled in accordance with section 10-518.

    (c)

    The city council shall not be bound by the traditional rules of evidence in hearings conducted under this article. Rules of evidence as applied in an administrative hearing shall apply. The city council may release the suspension of the pain clinics occupational tax certificate and/or an occupation tax permit issued under this article; and/or may assess penalties as detailed under section 10-521. Decisions of the city council are final and binding.
