§ 16-76. Discrimination prohibited; guidelines on sexual harassment.

  • (a)

    Title VII of the Civil Rights Acts of 1966 specifically prohibits discrimination in the hiring and firing of individuals or in any other "terms and conditions of employment," based on race, color, religion, national origin or sex. Sexual harassment is a form of sexual discrimination in violation of Title VII.

    (b)

    The Equal Employment Opportunity Commission guidelines on sexual harassment state that actions constitute sexual harassment when:

    (1)

    Submission to such conduct becomes explicitly or implicitly a term or condition of employment;

    (2)

    Submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting the individuals;

    (3)

    Such conduct has the purpose or the effect of interfering with work performance or creates an intimidating, hostile or offensive work environment.
