Article II. PLANNING COMMISSION |
§ 17-29. Principal powers and duties.
(a)
It shall be the function and duty of the planning commission to make such careful and comprehensive surveys and studies of existing conditions and probable future developments and to prepare such plans for physical, social, and economic growth as will best promote the public health, safety, morals, convenience, prosperity, or the general welfare as well as efficiency and economy in the development of the city.
(b)
In particular, the planning commission shall have the power and duty to:
(1)
Prepare or recommend amendments to a master plan or parts thereof for the development of the city.
(2)
Prepare and recommend for adoption to the city council a zoning ordinance and map for the city.
(3)
Prepare and recommend for adoption to the council regulations for the subdivision of land within the city or amendments to same; and administer regulations adopted.
(4)
Prepare and recommend for adoption to the council a plat or an official map showing the exact location of the boundary lines of existing, proposed, extended, widened or narrowed streets; public open spaces or public building sites; together with regulations to control the erection of buildings and other structures within such lines, within the city or a specified portion thereof.
(5)
Hold hearings as provided by law and make recommendations concerning the zoning and rezoning of areas within the zoning power of the city.
(6)
Consider and make recommendations as to the annexation of areas into the city and as to the conditions and zoning plans under which any such property should be annexed.
(7)
Perform such other functions and make such recommendations as they may deem advisable in the planning, adoption, enforcement, and carrying out of the long-range plans adopted by the city.
(c)
In addition, unincorporated areas adjacent to the city may be added to and included in the area under the jurisdiction of the planning commission for general planning and for master plan preparation and for the preparation and administration of zoning ordinances or resolutions, land subdivision regulations, and official maps, provided that the council and governing body of the county shall agree to the boundaries of such additional areas, procedures for joint action, procedures for the adoption and administration of ordinances and resolutions, and regulations applying to the area, and the manner of obtaining equitable representation on the municipal planning commission and board of zoning appeals. Such agreement shall be formally established by appropriate official action by the governing authorities involved.
