Article II. PERSONAL PROPERTY: STORAGE AND LIEN |
§ 18-26. Foreclosure of lien.
(a)
The city may file a claim of lien with the municipal court for any personal property held by the city for which storage charges have accrued for more than thirty (30) days. Such claim shall include an itemized list of all property, the date it came into possession of the city, the amount of the storage fee, and a copy of the notice mailed or advertised when the owner is unknown.
(b)
The municipal court judge shall enter an order foreclosing the lien and setting a date for auction. A notice shall then be published in the legal organ of Bartow County stating the date of auction and the items to be sold. The date of the auction shall be not less than ten (10) days from the date of the order.
(c)
Sale of personal property held by the city shall be conducted in accordance with auction procedures for the city.
(d)
Any item of personal property held by the city may be redeemed between the order of foreclosure and date of sale by proof of ownership, bill of sale, or title and the payment of the accrued storage fees together with twenty-five dollars ($25.00) court costs.
