§ 6-34. Existing buildings and special historic buildings.
(a)
The provisions of the construction codes relating to the construction, alteration, repair, enlargement, restoration, relocation or moving of buildings or structures shall not be mandatory for existing buildings or structures identified and classified by the state or local jurisdiction as historic buildings when such buildings or structures are judged by the building official to be safe and in the public interest of health, safety and welfare regarding any proposed construction, alteration, repair, enlargement, restoration, relocation or moving of buildings within fire districts.
(b)
In accordance with O.C.G.A. § 8-2-203, the provisions of O.C.G.A. Title 8, Chapter 2, Article 3, "Application of Building and Fire Related Codes to Existing Buildings" (O.C.G.A. § 8-2-200 et seq.) are hereby adopted by reference.
(c)
The building official and fire marshal for the city are hereby authorized to enforce the provisions of this section and O.C.G.A. § 8-2-200 et seq.
(d)
The building official and fire marshal, upon reviewing an existing building or special historic building to which this section is applicable, may, in their determination and sole discretion based upon the standards contained in O.C.G.A. § 8-2-200 et seq., require compliance alternatives as indicated therein.
(e)
However, this section is only applicable as to buildings constructed prior to December 31, 1945, and no exceptions to the building or fire codes pursuant to this section are permitted on buildings constructed after January 1, 1946.
(f)
This section is not applicable to buildings being used for residential uses or those used for industrial uses as specified in the city zoning ordinance.
(g)
No exceptions or compliance alternatives are allowed with respect to Section 101, Life Safety Code of the National Fire Codes, 1991, (1994) edition, as adopted by the city in section 9-27(a)(2) of this Code.
(h)
Appeals of decisions of the building official and/or fire marshal shall be made to the city construction board of adjustment and appeals pursuant to the procedures outlined in the Standard Building Code as adopted by the city and Chapter 6 of the City of Cartersville Code of Ordinances.
