§ 11-142. Open wells and excavations.
(a)
It shall be unlawful for any person to open and leave open pits, excavations, wells, cuts or ravines wider than five (5) feet or deeper than five (5) feet for a period of more than thirty (30) days. All pits, excavations, wells, cuts or ravines dug in the ground and left open without covers across their entire width and breadth at or above the ground level for a greater length of time than thirty (30) days are hereby declared to be nuisances and shall be abated by the city as provided by law.
(b)
The provisions of subsection (a) shall not apply to any area of the city defined by city ordinance as a mining area and managed, operated and protected in accordance with the mining regulations provided in ordinances creating or regulating such mining area.
