§ 11-143. Discharging firearms in city.

  • (a)

    It shall be unlawful for any person to discharge any firearms in the corporate limits of the city except in defense of person or property or as provided herein. This section shall not apply to authorized officers of the law.

    (b)

    A permit may be requested for a turkey shoot from the City of Cartersville Police Department.

    The minimum requirements for the issuance of a permit are as follows:

    (1)

    Must be minimum of one hundred (100) yards from roadway.

    (2)

    Must notify any adjacent property owners and/or occupants ten (10) days before event.

    (3)

    Must have adequate backstop or clearance so as not to endanger persons or property behind targets.

    (4)

    Must use bird shot only (number eight (8) or smaller).

    (5)

    Must use shotguns only.

    (6)

    Must have range limits on the right and left of the target line.

    (7)

    Must not begin firing prior to 9:00 a.m., and must end by dusk.

    (8)

    Firing is limited to Saturdays only.

    (9)

    Must have a person from the sponsoring organization designated as "Range Control" on-site at all time.

    (10)

    Warning signs must be posted at all approaches to, the sides and rear of the property where the shoot will take place, stating that live fire is in progress. The organization name shall be clearly posted.

    (11)

    Must be a bona fide, constituted, nonprofit organizations with the intent of fundraising charities.

    (12)

    Organizations shall require participants to wear adequate eye and ear protection when engaged in firing.

    (13)

    Must provide a copy of applicable insurance, if any.

    (c)

    Discharging firearms is allowed at an indoor firing range where firearm discharges are totally confined, including sound emissions.

    If the applicant has met or shows that they meet all of the above requirements, the chief of police is authorized to issue a permit for the turkey shoot. However he is not required to do so, if any of the above requirements have not been satisfied or he determines due to other factors that said turkey shoot location is unsuitable or the event poses a risk to the public safety of the surrounding properties or a previous event by said applicant was conducted improperly and in violation of the above requirements.
