§ 21-64. Enforcement.

  • (a)

    Customers, owners and waste haulers who do not comply with this article may be fined, and said container may be removed pursuant to the requirements of this article.

    (b)

    The code enforcement officer or other designee of the public works director is authorized to enforce this article.

    (c)

    All violations of this article shall be heard in the Cartersville Municipal Court and the court has the authority to order removal and/or repair of the container and/or levy a fine.

    (d)

    In addition to any other penalties of this article, a fine of up to one thousand dollars ($1,000.00) per day, per violation may be levied for any violations of this article.

    (e)

    The following violations shall be the user of the container's responsibility to correct and if after notice from the city and/or commercial/private garbage hauler whose container is being used, said user fails to correct the violations, he/she, or it is subject to the penalties provided by this article:

    (1)

    Litter around site of container;

    (2)

    Overflow of container;

    (3)

    Failure to close lid;

    (4)

    Failure to fence and/or secure container;

    (5)

    Bags and/or garbage outside of container;

    (6)

    That only legal materials are disposed of.
