§ 3.3. Interpretation of zoning district boundaries.

Latest version.
  • When uncertainty exists with respect to the location of boundaries of any zoning district as shown on the official zoning map of the City of Cartersville, Georgia, the following rules shall apply:

    3.3.1.

Unless otherwise specifically indicated, where district boundaries are indicated on the zoning map as approximately following the centerline of a street, highway, railroad right-of-way line, stream bed or river bed; such centerline shall be construed to be such district boundaries.

    3.3.2.

Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.

    3.3.3.

Where district boundaries are indicated on the zoning map as approximately following the corporate limit line of the city, such corporate limit lines shall be construed to be such district boundaries.

    3.3.4.

Where district boundaries are indicated on the zoning map as being set back from a street, road, highway, railroad, stream, or river, and parallel thereto, then such district boundaries unless otherwise specifically indicated, shall be construed as being at the scaled distance from the centerline of such street, road, highway, railroad, stream, or river and as being parallel thereto.

    3.3.5.

Where a public road, street, alley, or other right-of-way is officially vacated or abandoned, the zoning applicable to the property to which it is reverted shall apply to such vacated or abandoned road, street, alley, or right-of-way.

    3.3.6.

Where a district boundary divides a lot existing on or before November 7, 1996, the location of such boundaries, unless same are indicated by dimensions, shall be determined by use of the scale appearing on such maps. Property owners may request the city rezone the entire property to one (1) of the existing zonings or subdivide the property along the district boundary provided all lot standards are achieved for each newly created lot.
