§ 24-8. Water ban.

  • (a)

    In the event that the city manager declares a water ban or one (1) is declared by the State of Georgia or Federal Government, the following fine schedule is adopted unless stricter fines are otherwise provided for by the State of Georgia or Federal Governments.

    (b)

    The fines during the water ban are as follows:

    (1)

    A first offense (Warning).

    (2)

    A second offense one hundred dollars ($100.00).

    (3)

    A third offense two hundred dollars ($200.00).

    (4)

    A fourth offense two hundred fifty dollars ($250.00) (plus loss of service for three (3) days).

    (5)

    A fifth offense five hundred dollars ($500.00) (plus loss of meter for thirty (30) days).

    (c)

    The Water Superintendent of the City of Cartersville may designate employees of the City of Cartersville Water Department to issue citations for violations of this section in addition to city police officers and code enforcement officers.

    (d)

    All violations of this section shall be prosecuted in the City of Cartersville Municipal Court. In addition, the fines and fees assessed hereunder may be added to the violator's monthly water and sewer bill and collected in the same manner as utility bills are for the City of Cartersville.

    (e)

    The City of Cartersville hereby adopts by reference for enforcement any restrictions and/or any watering ban imposed for its geographic boundaries by the State of Georgia effective now or as adopted or modified by the State of Georgia from this date forward.

    (1)

    Cartersville Water Department local option additional exemptions:

    (i)

    Water leaks on private lines will be considered a violation of the outdoor watering ban if not repaired within seven (7) days of notification by the Cartersville Water Department.
